The website dirtyartists.com (the “Site”) and related platforms, products, and services available on or from the Site (the “Services”) are owned and operated by Dirty Group, a California limited liability company, located at 506 N Helberta Avenue, Unit #6, Redondo Beach, CA 90277 (together with its affiliates, successors, and assigns, hereinafter referred to as “Dirty Group,” “we,” “our,” or “us”).
Dirty Artists is a platform operated by Dirty Mondays (“DM”), a live music promoter. The Site enables musical artists and bands to submit applications to perform at events produced or curated by Dirty Mondays, including Dirty Gigs and Dirty Fest. The Site also functions as an artist profile and discovery platform for DM’s booking team and connected industry partners.
BY ACCESSING OR USING THE SITE AND SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS (“TERMS”) AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SITE OR SERVICES.
NOTICE OF ARBITRATION: THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND A CLASS ACTION WAIVER IN SECTION 13. PLEASE READ THEM CAREFULLY. BY USING THE SITE, YOU AGREE TO RESOLVE DISPUTES WITH US THROUGH BINDING INDIVIDUAL ARBITRATION AND WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS.
1. DEFINITIONS
For the purposes of these Terms, the following definitions apply:
- “Site” means the website located at dirtyartists.com and any related subdomains.
- “Services” means all features, tools, and functionality available through the Site, including artist profile creation, gig applications, EPK generation, messaging, and gig browsing.
- “User” means any individual who accesses or uses the Site, whether or not they create an account.
- “Registered User” means any individual who has created an account on the Site.
- “Band” or “Artist” means the musical act or project represented by a Profile on the Site.
- “Profile” means the public-facing representation of a Band on the Site, containing information, media, and content submitted by the User.
- “Application” means a submission made through the Site to be considered for performance at a Dirty Mondays event.
- “User Content” means all materials submitted by a User to the Site, including but not limited to band names, biographical information, photographs, videos, audio recordings, social media links, performance history, and any other information or media.
- “EPK” means the Electronic Press Kit generated by the Site from a Band’s Profile data.
2. ELIGIBILITY
The Site and Services are intended for use by persons who are at least 18 years of age. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are under 18, you may not use the Site or Services under any circumstances.
We do not knowingly collect personal information from anyone under the age of 18. If we learn that a User is under 18, we will terminate their account and delete their data promptly.
3. ACCOUNT REGISTRATION AND SECURITY
To access certain features of the Site, you must register for an account by providing your full name, email address, phone number, and other information requested during the onboarding process (collectively, “Registration Information”).
You represent and warrant that all Registration Information you provide is true, accurate, complete, and current, and that you will update it promptly to keep it so.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at info@dirtymondays.com if you become aware of any unauthorized use of your account.
We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice.
4. BAND PROFILES AND REPRESENTATIVE AUTHORITY
Each account may be associated with one or more Band Profiles. A single User may create and manage multiple Band Profiles from a single account.
If you create or manage a Profile on behalf of a band, group, artist, company, or other entity, you represent and warrant that you have the legal authority to bind that entity to these Terms and to act on its behalf in all matters related to the Site and Services. You are personally responsible for ensuring that entity’s compliance with these Terms.
You may invite other Users to collaborate on a Band Profile. The User who created the Band Profile is the primary administrator and is responsible for all content and activity associated with that Profile, including content contributed by invited collaborators.
A Band Profile may be made publicly visible to other Users of the Site, to the Dirty Mondays booking team, and to connected industry partners including labels, managers, and promoters affiliated with Dirty Mondays. By creating a Profile, you consent to this visibility.
5. APPLICATIONS AND BOOKING
The Site enables Bands to submit Applications to perform at events produced or curated by Dirty Mondays. By submitting an Application, you acknowledge and agree that:
- Submitting an Application does not guarantee a booking, a response, or any specific outcome.
- All booking decisions are made at Dirty Mondays’ sole discretion based on factors including but not limited to artistic merit, genre fit, market demand, live performance quality, draw potential, and scheduling availability.
- Dirty Mondays is under no obligation to review, respond to, or provide feedback on any Application.
- Dirty Mondays may contact you regarding your Application via email, phone, or the Site’s messaging system.
- Application data, including all information submitted during the onboarding process, becomes part of your Band Profile and may be used by Dirty Mondays for booking evaluation and CRM purposes.
If you are selected for a booking, the specific terms of that engagement (including compensation, logistics, and performance requirements) will be communicated separately and are not governed by these Terms.
6. USER CONTENT
6.1 Ownership
You retain all ownership rights in your User Content. Nothing in these Terms constitutes a transfer of ownership of any User Content from you to us.
6.2 License Grant
By submitting User Content to the Site, you grant Dirty Group a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, perform, modify, and create derivative works of your User Content, in whole or in part, in connection with the operation, promotion, and improvement of the Site and Services. This includes, without limitation:
- Displaying your Profile and User Content to the Dirty Mondays booking team and connected industry partners.
- Generating and distributing your EPK.
- Featuring your Profile in promotional materials for the Site or for Dirty Mondays events.
- Displaying your Profile publicly on the Site if you have enabled public visibility.
This license survives termination of your account with respect to User Content that has been shared with or distributed to third parties prior to termination (e.g., EPKs that have been downloaded or Profiles that have been shared with booking partners). Upon termination of your account, we will cease active use of your User Content within a commercially reasonable time.
6.3 Your Responsibilities
You are solely responsible for all User Content you submit. You represent and warrant that:
- You own or have all necessary rights, licenses, and permissions to submit your User Content and to grant the licenses described in these Terms.
- Your User Content does not infringe, misappropriate, or violate any third party’s intellectual property rights, rights of publicity, rights of privacy, or any other legal rights.
- Your User Content does not contain any material that is unlawful, defamatory, obscene, harassing, threatening, discriminatory, or otherwise objectionable.
- All factual statements in your User Content (including performance history, attendance figures, and biographical information) are truthful and not materially misleading.
6.4 Content Removal
We reserve the right, but have no obligation, to monitor, review, edit, or remove any User Content at our sole discretion and without notice, for any reason, including but not limited to content that we believe violates these Terms or applicable law.
7. ELECTRONIC PRESS KIT (EPK)
The Site may generate a downloadable EPK for each Band Profile using the User Content and Profile data you have provided. By using this feature, you acknowledge and agree that:
- The EPK is generated automatically from your Profile data. You are responsible for ensuring that all information in your Profile is accurate and current before downloading or distributing your EPK.
- Once you download or share your EPK with third parties, we are not responsible for how those third parties use the information contained in it.
- The EPK will include Dirty Artists branding. You may not remove, alter, or obscure the Dirty Artists branding on any EPK generated by the Site.
8. PROHIBITED CONDUCT
You agree that you will not, and will not permit any third party to:
- Use the Site or Services for any unlawful purpose or in violation of any applicable law or regulation.
- Create a false identity, impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Submit any User Content that is false, misleading, defamatory, obscene, harassing, threatening, discriminatory, or otherwise objectionable.
- Submit User Content that infringes the copyright, trademark, or other intellectual property rights of any third party.
- Harvest, collect, or scrape email addresses or other contact information of Users from the Site.
- Use automated scripts, bots, spiders, scrapers, or other automated means to access the Site or collect data from the Site.
- Use the Site to send unsolicited communications, spam, or promotional materials to other Users.
- Attempt to artificially inflate Profile metrics, rankings, or visibility through fraudulent means.
- Interfere with, disrupt, or place an unreasonable burden on the Site or its infrastructure.
- Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Site or Services.
- Use the Site to solicit Users to register with or migrate to a competing platform or service.
- Upload or transmit any viruses, malware, or other harmful code.
Violation of this Section may result in immediate termination of your account without notice.
9. INTELLECTUAL PROPERTY
9.1 Our Intellectual Property
The Site, its design, layout, features, functionality, and all content created by Dirty Group (including but not limited to the Dirty Artists name, logo, trademarks, graphics, software, and code) are the exclusive property of Dirty Group and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, modify, or distribute any of our intellectual property without our prior written consent.
9.2 Copyright Complaints (DMCA)
We respect the intellectual property rights of others. If you believe that any User Content on the Site infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (“DMCA”) by providing the following information in writing to our designated agent:
- A physical or electronic signature of the copyright owner or authorized agent.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material on the Site that is claimed to be infringing, with sufficient detail to enable us to locate it.
- Your contact information (name, address, telephone number, email).
- A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

11. DISCLAIMERS
THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY APPLICATION WILL RESULT IN A BOOKING, RESPONSE, OR ANY PARTICULAR OUTCOME.
WE DO NOT ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY USER CONTENT, PROFILES, OR COMMUNICATIONS BETWEEN USERS. YOUR INTERACTIONS WITH OTHER USERS OR THIRD PARTIES ARE AT YOUR OWN RISK.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DIRTY GROUP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
13. DISPUTE RESOLUTION
13.1 Governing Law
These Terms and any dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
13.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Site (collectively, “Disputes”) shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration shall take place in Los Angeles County, California, or at another mutually agreed location. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
13.3 Class Action Waiver
YOU AND DIRTY GROUP AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
13.4 Exceptions
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.
14. TERMINATION
You may terminate your account at any time by contacting us at info@dirtymondays.com or using the account deletion feature in your Settings.
We reserve the right to suspend or terminate your account and access to the Site at any time, with or without cause, and with or without notice, including but not limited to cases where we reasonably believe you have violated these Terms.
Upon termination, your right to use the Site ceases immediately. We will delete your account data within thirty (30) days of termination, except where we are required to retain it by law or for legitimate business purposes (e.g., resolving disputes, enforcing agreements, or complying with legal obligations). Anonymized and aggregated data derived from your use of the Site may be retained indefinitely.
If your account has been inactive (no login) for twelve (12) consecutive months, we may consider the account inactive and reserve the right to delete it after providing thirty (30) days’ notice via the email address associated with the account.
15. MODIFICATIONS TO THESE TERMS
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the updated Terms on the Site and updating the “Effective Date” above. We may also notify you via email at the address associated with your account.
Your continued use of the Site after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site and may terminate your account.
16. GENERAL PROVISIONS
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Dirty Group regarding your use of the Site and Services, and supersede all prior or contemporaneous agreements, understandings, or representations.
Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Waiver. Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision.
Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.
No Agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Dirty Group.
